Gun & Firearm Crime Defense
Gun crimes are heavily prosecuted in the state of Wisconsin. In Milwaukee, where gun violence tends to be higher than in the rest of the state, those convicted of a gun crime face significant jail and/or prison time, tens of thousands in fines, and a criminal record that can follow them around for a lifetime. If you’ve been charged with a gun or firearm crime, you need to prepare yourself for a tough fight.
At Fenton Law Office, Attorney Jay Fenton supports individuals in Milwaukee and surrounding communities who have been charged with gun or firearm crimes. Understanding Wisconsin’s Gun Laws
Gun and firearm laws are established at both the federal and state level. At the federal level, these laws are largely enacted by Congress through legislation. Federal gun and firearm laws are codified in Title 18 of the United States Code (U.S.C.). State gun and firearm laws vary considerably from state to state, but most states have adopted similar regulations to those at the federal level.
Federal law prohibits the purchase of a firearm by anyone who has been convicted of a felony. Federal law also requires that all firearms dealers be licensed, and imposes strict regulations on the sale of firearms.
State of Wisconsin gun laws operate on a “shall issue” policy. This means that Wisconsin will issue a concealed carry permit to any qualified applicant who meets the requirements set forth by state law. There is no waiting period for the issuance of a concealed carry permit in Wisconsin.
In order to purchase a firearm from a licensed dealer in Wisconsin, you must be at least 18 years of age. You must also have a valid photo ID, such as a driver’s license or passport. If you are purchasing a handgun, you must also have a Handgun Safety Certificate. There is no waiting period to purchase a firearm in Wisconsin.
You cannot purchase or possess a firearm in the state of Wisconsin if you are under the age of 18, have been convicted of a felony, or if you are subject to a domestic violence restraining order.
It is important to note that gun and firearm laws are subject to change at any time, and it is advisable to stay up-to-date on the latest changes if you currently own a gun.
